Late last year, Canada Post and the Public Service Alliance of Canada became embroiled in a heated strike action over sick pay benefits. In the midst of the dispute, several PSAC members took direct aim at Canada Post CEO Moya Greene, recording a short parody video titled "The Greench." The video, which was posted on YouTube, adapted the well-known Dr. Seuss tune "You’re a Mean One, Mr. Grinch" to criticize Greene and the company. While the creation of a protest video is not particularly noteworthy, what followed soon after is.  Just as the video began to attract some attention, YouTube removed it after receiving a complaint from Canada Post alleging that the video violated the company’s copyright

Under the law, the web host avoids liability if it immediately removes the content. No court or independent third party reviews the infringement claim since nothing more than a complaint that meets certain criteria is needed. The statutory requirements include providing a statement that the complainant has a "good faith belief that use of the material in the manner complained of its not authorized by the copyright owner, its agent or the law."

Proprio ieri in una riunione con una decina di persone, spiegavo che a mio avviso spostare il controllo dal contenuto al mezzo di trasmissione, come e' la strategia attuale delle major, espone al rischio che, oltre ai contenuti palesemente illeciti, con la scusa di una presunta illiceità lo stesso meccanismo possa essere utilizzato per tacitare il dissenso, per eliminare critiche e parodie che invece, rispetto alle norme, sono utilizzi leciti.

Questo post di Michael Geist e' proprio un esempio di ciò. per buttare l'acqua sporca, si butta anche il bambino. Occorre un ripensamento delle utilizzazioni libere ed una responsabilizzazione degli utenti in modo che chi commette un illecito, venga sanzionato. Il non sanzionare chi commette gli illeciti, alla fine, danneggia anche chi non li commette.

Finnish regulator Ficora will cease its efforts to ease wholesale broadband access regulation, due to opposition from the European Commission. The regulator initially proposed de-regulation in the major cities, because the retail and wholesale fees for broadband services are already lower than the country average.

• Australia: la corte civile australiana ha bocciato la segmentazione geografica.
• Austria: la corte civile austriaca ha bocciato la segmentazione geografica. qui. (ne avevo gia' dato conto)
• Finlandia: "seri dubbi" della commissione su segmentazione geografica, richiesta di inclusione della fibra. qui. FInlandia abbandona.
• Olanda: conferma la suddivisione tra wholesale broadband ad alta e bassa qualita (overbooking <1:20 e >1:20); presenti obblighi per la fibra. qui.
• Portogallo: ok alla segmentazione geografica per un'area che include il 61% delle linee, zone densamente popolate dove ci sono almeno 3 operatori e molte abitazioni con cableTV; la commissione enfatizza l'importanza di includere la fibra. qui e qui.
• Spagna: no segmentazione geografica bitstream, la commissione ha formulato "seri dubbi" (un formalismo regolamentare che precede l'esercizio del diritto di veto della UE) su assenza della fibra con reazione di CMT qui e qui

Digital Britain: rilasciato il primo rapporto

Quello definitivo e' atteso per luglio.

Department for Culture Media and Sport - digital britain - interim report. The interim report contains more than 20 recommendations, including specific proposals on:

• next generation networks
• universal access to broadband
• the creation of a second public service provider of scale
• the modernisation of wireless radio spectrum holdings
• a digital future for radio
• a new deal for digital content rights
• enhancing the digital delivery of public services

Ireland - P2P infringement case settled

Dublin, 29th January 2009

High Court proceedings between four major record companies, EMI, Sony, Universal and Warner and Eircom which have been at trial for eight days, have been settled on an amicable basis with both sides expressing satisfaction with the outcome.

Both parties have agreed on a joint approach under which they will work closely together to end the abuse of the internet by P2P (peer-to-peer) copyright infringers.

The settlement reached between the parties provides that the record companies will supply Eircom with the IP addresses of all persons who they detect illegally uploading or downloading copyrighted works on a P2P basis.

Eircom has agreed that it will from now on implement a graduated process in which it will;

1. inform its broadband subscriber that the subscriber’s IP address has been detected infringing copyright and

2. warn the subscriber that unless the infringement ceases the subscriber will be disconnected and

3. in default of compliance by the subscriber with the warning it will disconnect the subscriber.

The record companies have agreed with Eircom that they will take all necessary steps to put similar agreements in place with all other ISPs in Ireland.

Grazie Franz. Apple vs. Palm: the in-depth analysis - Engadget.  Articolo molto dettagliato ed esplicativo. la conclusione piu' ovvia è che non succederà nulla perchè...

All you really need to know is that by suing Palm, Apple's putting its iPhone patents at risk, and that's an awful big ante. Same for Palm if it sues Apple and loses -- it stands the risk of losing its patents, and we'd bet it's making a tidy sum licensing at least some of them out to other companies.
